I
n every real estate sales transaction, a real
estate agent shall, at first substantial contact directly with a
prospective buyer or seller,
provide the prospective buyer or seller
with the following

*First substantial contact between you and a
real estate agent is defined as the disclosure by you of
confidential information.
*Sellers need to immediately understand one
concept in this regard: 1) Do not yet disclose any information
to a potential listing firm that you would not want a buyer to know
until a Listing Agreement has been signed. Until that happens
you are not a "client" of the firm, the firm's loyalties do not lie
completely with you, and your disclosures, even confidential ones
are not yet protected.
*Dual Agency: If your listing agent has a
buyer for your listing this is called Dual Agency. In this
case the agent owes equal responsibilities to both you and the
buyer. He or she must split their loyalties and ensure that
all parties are treated fairly and equally. You have the
choice in the NC Listing Agreement to allow or reject Dual Agency as
a condition of the listing.
*Designated Agency: This is a special form of
Dual Agency that allows you a more full representation than simple
Dual Agency when a firm has a buyer interested in your property. In
short, the firm designates separate brokers within the firm to
represent buyer and seller. The information and interests of
both parties are now more fully protected than under simple Dual
Agency. Black Bear Realty, Inc prefers this type of
arrangement whenever possible. Under the NC Listing Agreement,
you have the right to accept or reject Designated Dual Agency.
